Case: Billy and Klayton created a new type of seat cushion that automatically warms in freezing temperatures when a person sits on it. The invention was ideal for outdoor sporting events. Billy and Klayton then began selling their new product. Subsequently, Riley and Kyle attended a sporting event where Billy and Klayton’s seat cushions were used. Riley and Kyle were both injured at the same time when the seat cushions heated up too much. Riley and Kyle then decided to sue Billy and Klayton for negligence in Federal Court. Billy is from Maine, Klayton is from South Dakota, Riley is from Maine and Kyle is from North Dakota. Riley and Kyle sue Billy and Klayton for $75,000.01.
