Question: In determining negligence, the use of the “reasonable man” standard has evolved through the years to be defined more often as a “reasonable person” standard. One could argue the evolution was designed to make the negligence standard gender neutral. However, in her article The Reasonable Person: A Gendered Concept, author Wendy Parker argues that use of a “reasonable person” standard to define negligence may be “a far more insidious piece of sexist language than the reasonable man….” standard. After reviewing the article, identify the primary reasons Parker contends that the reasonable man standard is not actually gender neutral. Explain whether you agree or disagree with her contention. Identify the standard Parker maintains could be utilized as an effective “universal standard” in defining negligence. Explain whether you agree or disagree with her position.
