Question: Kelly concedes she has been in default of her mortgage loan repayments over a beach house in Halls Head. The mortgagee is XYZ Building Society (XYZ). She has not made a payment on the capital sum or interest for a period of three months when XYZ places her beach house on the market as a “vacant block of land” being offered by way of mortgagee sale. XYZ is closely connected with Hillary “Whitewater” Clinton, a local property developer, who sits on its board of directors and has jealously regarded Kelly’s corner location overlooking the glorious Indian Ocean.
Clinton wants to knock down the ramshackle beach house and put up executive apartments. XYZ hastily arranges an auction for a Friday afternoon, at which there are two bidders. One is an agent for XYZ, Dan Andrews, and there is a phone bidder – Clinton’s “niece” Mary Bent, a close business confidante. The property is sold to Bent for a mere $200 000 – less than half of its market valuation.
